Program Disclaimer
As part of its mission to support the clean energy industry with environmental, health, and safety resources, the American Clean Power Association (the “ACP) is facilitating an information sharing program among its members (the “Safety Alert Program” or “SAP”). SAP is a program that allows for members of the Environmental, Health, and Safety Subcommittee of the ACP (the “EH&S Committee”) to voluntarily share information regarding safety incidents and related learnings among member companies. A member can present information to be shared with other members on a form prepared by the ACP (the “Incident Disclosure Form”). The ACP will deidentify the information submitted and provide it to the members of the EH&S Committee in the form of an ACP Safety Alert.
The members participating in SAP desire to exchange certain information with one another for the purpose of improving safety practices across the clean energy industries (the “Purpose”). The findings and information shared among members through this program may be used by a member in its own safety programs. Each member is voluntarily providing the information, and no member is under any obligation to provide information by participating in the SAP. It is hereby understood that each receiving member shall utilize the Safety Alerts only for the Purpose and will not disclose the Safety Alerts beyond its own organization. The information exchanged between members must be understood as a tool for addressing workplace hazards, rather than an exhaustive statement of an employer’s legal obligations, which are defined by statute, regulations, and health, safety and other standards.
EACH PARTICPATING MEMBER UNDERSTANDS AND ACKNOWLEDGES THAT THE INFORMATION RECEIVED IN CONNECTION WITH THE SAP IS PROVIDED WITHOUT ANY REPRESENTATION OR WARRANTY, EXPRESSED OR IMPLIED, AS TO THE ACCURACY OR COMPLETENESS OF THE INFOMRATION SO PROVIDED. ANY RELIANCE ON OR USE OF THE INFORMATION BY A MEMBER IS AT SUCH MEMBER’S SOLE RISK AND MEMBERS ARE ADVISED TO CONSULT AN ATTORNEY AND/OR SAFETY PROFESSIONALS BEFORE TAKING ANY ACTION.
