The one-pager and detailed summary are based on the legislative text released on September 30, 2026, the Bipartisan American Affordability and Jobs Act of 2026.

The bill provides three principal protections for projects:

  • Certainty for projects that already have their federal approvals
  • Enforceable deadlines for projects still in permitting
  • Significant remedies for systematic disparate treatment of particular project types

It also makes broad changes to:

  • Federal transmission siting, planning and cost allocation
  • NEPA
  • Clean Water Act
  • Endangered Species Act
  • Historic-preservation review
  • Federal-land renewable-energy permitting
